Terms & Conditions for Use of the DK Mart Online Store

 

These Terms of Service (“Terms”) govern your access to and use of the DK Mart website, online store, customer account functionality and related services (collectively, the “Services”). By accessing or using the Services, placing an order, creating an account or otherwise interacting with DK Mart, you agree to be bound by these Terms, together with the policies and terms expressly incorporated into them.

If you do not agree with these Terms, please do not use the Services. Nothing in these Terms is intended to exclude, restrict or waive any right or remedy that cannot lawfully be excluded under applicable law.

1. ABOUT DK MART

DK Mart is an online retail business offering products that may include electrical appliances, kitchen and home products, mobile accessories, kids' educational products, craft products, utility products and other consumer goods.

“DK Mart”, “we”, “us” and “our” refer to [ASHWIN B. KUKADIYA], trading under the brand name DK Mart.

2. ELIGIBILITY TO USE THE STORE

You must have the legal capacity required under applicable law to enter into a purchase transaction.

Where a person who does not have such legal capacity uses the Services, the Services should be used under the supervision and responsibility of a parent, guardian or other person legally authorised to do so, as applicable.

You are responsible for ensuring that information provided to DK Mart is accurate and current.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You must not use the Services to commit fraud, abuse, interfere with the operation or security of the website, attempt unauthorised access, introduce malicious code, scrape or harvest information in a manner not permitted by DK Mart, or otherwise misuse the Services.

DK Mart may restrict, suspend or terminate access where reasonably necessary to protect the website, customers, business or legal rights, subject to applicable law.

4. CUSTOMER ACCOUNTS

Certain features may require or permit a customer account.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account, except where the activity results from circumstances outside your reasonable control.

You must notify DK Mart promptly if you suspect unauthorised access to your account.

DK Mart may suspend or restrict an account where reasonably necessary for security, fraud prevention, misuse or legal compliance.

5. PRODUCT INFORMATION

We aim to present product descriptions, images, specifications, dimensions, colours, compatibility information, prices and availability accurately.

Product images may vary slightly from the actual product because of screen settings, lighting, photography, manufacturing variations or packaging updates.

Where a product has manufacturer specifications, the manufacturer's current specifications may take precedence over illustrative information, subject to applicable consumer law.

Customers should review the product description, specifications, compatibility, warranty information and applicable return conditions before placing an order.

6. PRODUCT SAFETY & INSTRUCTIONS

Products should be used only for their intended purpose and in accordance with applicable manufacturer instructions, warnings and safety information.

For electrical and electronic products, customers should follow the manufacturer's installation, voltage, charging, operating and maintenance instructions.

Where professional installation is recommended or required, customers should use an appropriately qualified person.

DK Mart does not authorise customers to modify, dismantle or repair products contrary to manufacturer instructions.

7. PRICES, TAXES & AVAILABILITY

Prices displayed on the website are subject to change without prior notice, except where applicable law requires otherwise.

Applicable taxes, including GST where applicable, and shipping or other charges will be displayed or otherwise disclosed as required before purchase.

DK Mart makes reasonable efforts to maintain accurate pricing and availability. In the event of an obvious technical or pricing error, DK Mart may take appropriate corrective action subject to applicable law.

8. ORDERS & ORDER ACCEPTANCE

Placing an order constitutes a request to purchase the selected products. An order is not necessarily accepted merely because it has been submitted or a payment attempt has been made.

DK Mart may accept, reject or cancel an order where reasonably necessary, including because of product unavailability, pricing or listing errors, suspected fraud, delivery limitations, payment problems or other legitimate operational reasons, subject to applicable law.

Where DK Mart cancels an order after payment has been received, the applicable amount will be refunded in accordance with the applicable refund process and law.

9. ORDER CONFIRMATION

After placing an order, you may receive an order acknowledgement or confirmation by email, SMS, WhatsApp or another available communication channel.

An order confirmation is intended to confirm receipt and relevant order details; it does not necessarily constitute final acceptance where DK Mart's order process requires further verification.

10. PAYMENT

Payments may be processed through third-party payment gateways or other payment service providers.

DK Mart does not intentionally request or store complete payment-card numbers, CVV/CVC codes, UPI PINs, banking passwords or OTPs on its own systems.

You must not provide confidential payment credentials to anyone claiming to be a DK Mart representative.

Payment failures, reversals, chargebacks and other payment events may be subject to the terms of the applicable payment provider as well as these Terms.

11. CASH ON DELIVERY

Where Cash on Delivery (“COD”) is available, DK Mart may apply eligibility, order-value, location or verification conditions.

DK Mart may contact a customer to confirm a COD order before dispatch.

Repeated refusal or non-acceptance of correctly fulfilled COD orders may result in restrictions on future COD availability, subject to applicable law.

12. SHIPPING & DELIVERY

Delivery is subject to the shipping address, serviceability, product availability, processing time and logistics conditions.

Estimated delivery dates are estimates unless expressly stated otherwise. Delays may occur because of courier disruptions, weather, natural events, public holidays, technical issues, regulatory restrictions or circumstances outside DK Mart's reasonable control.

13. RETURNS, REFUNDS, CANCELLATIONS & WARRANTIES

Returns, refunds and replacements are governed by DK Mart's Return & Refund Policy.

Order cancellation is governed by the applicable cancellation terms and order status.

Where a product has a manufacturer's or seller's warranty, the applicable warranty terms will govern the warranty service.

Nothing in these Terms or the related policies is intended to exclude mandatory statutory rights or remedies.

14. PRODUCT-SPECIFIC TERMS

Certain products may have additional terms concerning installation, compatibility, warranty, safety, age suitability, consumability, software or other characteristics.

Where product-specific terms are displayed before purchase, those terms form part of the transaction, subject to applicable law.

15. PROMOTIONS, DISCOUNTS & COUPONS

Promotional offers, discounts, coupon codes, cashback offers, free gifts and other campaigns may be subject to additional terms and eligibility requirements.

Unless expressly stated otherwise, promotions cannot be combined and may be limited by product, customer, quantity, location, payment method or time period.

DK Mart may correct or withdraw a promotion where necessary because of a genuine error, fraud or misuse, subject to applicable law and any rights already accrued.

16. REVIEWS, RATINGS & USER CONTENT

Customers may be invited to submit reviews, ratings, photographs or other content.

You must not submit content that is unlawful, fraudulent, defamatory, abusive, infringing, misleading, obscene, malicious or otherwise inappropriate.

You represent that you have the necessary rights to submit content you provide.

DK Mart may moderate, refuse, edit for formatting or remove content that violates these Terms, applicable law or reasonable content standards.

By submitting content, you grant DK Mart a non-exclusive, worldwide, royalty-free permission to use, reproduce, display and distribute that content for operating, reviewing and promoting DK Mart, subject to applicable law and our Privacy Policy.

17. LIVE VIEWERS, ACTIVITY INDICATORS & PERSONALISATION

DK Mart may use aggregated or appropriately configured activity indicators, such as approximate numbers of visitors or product viewers, to improve the shopping experience.

Such features are not intended to publicly identify individual customers.

DK Mart may also use browsing and purchase activity to provide recently viewed items, related products, recommendations or personalised content where permitted by applicable law.

18. INTELLECTUAL PROPERTY

Unless otherwise stated, the DK Mart website and its content, including logos, branding, text, graphics, product presentation, layout, photographs, videos, software and other materials, are owned by or licensed to DK Mart and are protected by applicable intellectual-property laws.

You may access and use the website for personal and lawful shopping purposes. You must not reproduce, modify, distribute, publicly display, sell, licence or commercially exploit DK Mart content without prior written permission, except where permitted by law.

19. THIRD-PARTY SERVICES & LINKS

You must not use the Services to engage in fraudulent transactions, impersonation, unauthorised account access, payment abuse, automated attacks, malicious activity, unlawful scraping, interference with security features, attempts to circumvent purchase limits or promotions, or any activity that violates applicable law.

DK Mart may investigate suspected abuse and take lawful steps to protect the store, customers and its rights.

22. ERRORS & WEBSITE AVAILABILITY

DK Mart aims to keep the Services available and accurate but does not guarantee that the website will always be uninterrupted, error-free or available.

Information may occasionally contain typographical, technical or other errors. DK Mart may correct errors and update information as reasonably necessary, subject to applicable law.

Maintenance, upgrades, security measures and circumstances outside DK Mart's reasonable control may temporarily affect availability.

23. DISCLAIMERS

Except where expressly stated or required by applicable law, the Services and website content are provided on an “as available” basis.

DK Mart does not make absolute guarantees that the website will always be uninterrupted, completely error-free, or free from all security threats.

Product warranties, guarantees or statutory rights that apply to a product are not excluded by this section.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, DK Mart will not be liable for indirect, incidental, special or consequential losses arising solely from use of the website or inability to use the Services.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including applicable statutory consumer rights or liability arising from circumstances where limitation is prohibited by law.

Where liability may lawfully be limited, any limitation will apply only to the extent permitted by applicable law.

25. INDEMNITY

To the extent permitted by applicable law, you agree to be responsible for losses, claims, costs or expenses reasonably arising from your unlawful use of the Services, fraud, intentional misuse, violation of these Terms, or infringement of another person's rights caused by your conduct.

This provision does not require you to indemnify DK Mart for matters caused by DK Mart's own unlawful conduct or for liabilities that cannot legally be transferred to you.

26. SUSPENSION OR TERMINATION

DK Mart may suspend or terminate access to an account or particular Services where reasonably necessary because of fraud, abuse, security concerns, violation of these Terms, legal requirements or operational reasons.

Termination does not affect rights or obligations that arose before termination or provisions that by their nature should continue after termination.

27. FORCE MAJEURE

DK Mart will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, government action, strikes, major network or infrastructure failures, courier disruptions or other comparable events.

DK Mart will take reasonable steps to resume affected Services when practicable.

28. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India, subject to applicable consumer-protection and other mandatory laws.

Subject to any mandatory consumer dispute forum, statutory remedy or other jurisdiction that cannot lawfully be excluded, disputes relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts/authorities at [CITY, STATE, INDIA].

29. CONSUMER RIGHTS

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, Cancellation Policy, Warranty Policy and any product-specific or promotional terms expressly incorporated into them, constitute the applicable agreement governing use of the Services and purchases from DK Mart, subject to applicable law.
